Terms of Service
1. Service Agreement
By engaging CreativeBrandFlow for brand identity and creative direction services, you enter into a binding agreement subject to these Terms of Service. All services are provided from our office at Erikaweg 16, 42697 Solingen, Germany.
2. Scope of Services
CreativeBrandFlow provides brand identity design, visual guidelines development, creative direction, and related creative services. Specific deliverables, timelines, and pricing are outlined in individual project proposals and invoices.
3. Payment Terms
Payments are due according to the milestone schedule outlined in your project agreement. A 50% deposit is required before work begins. Remaining balance is due upon project completion and before final file delivery. Late payments incur a 2% monthly fee.
4. Intellectual Property
Upon full payment, all final deliverables and associated intellectual property rights are transferred to the client. CreativeBrandFlow retains the right to display completed work in portfolio and marketing materials unless otherwise agreed in writing.
5. Revisions & Changes
Standard projects include two rounds of revisions. Additional revisions are billed at €75 per round. Significant scope changes require a new project proposal and may affect pricing and timeline.
6. Project Timeline
Timelines are estimates based on current workload and client responsiveness. Delays in providing feedback or assets may extend the project timeline. CreativeBrandFlow will communicate any delays promptly.
7. Limitation of Liability
CreativeBrandFlow's liability is limited to the total amount paid for the specific project. We are not responsible for indirect damages, lost profits, or consequential losses arising from our services.
8. Termination
Either party may terminate the agreement with 14 days written notice. Upon termination, client is responsible for payment of all work completed up to the termination date.
Refund Policy
1. Refund Eligibility
CreativeBrandFlow offers refunds based on project milestones completed and work delivered. Refund requests must be submitted in writing to [email protected] within 14 days of the relevant invoice date.
2. Deposit Refunds
The initial 50% deposit is non-refundable once work has commenced. If work has not begun, a full deposit refund may be issued at our discretion within 7 business days of the request.
3. Milestone-Based Refunds
For projects with multiple milestones, refunds are calculated based on work completed versus work remaining. Deliverables already approved and paid for are non-refundable.
4. Completed Work
Once a project phase is completed and approved by the client, payment for that phase is non-refundable. Approval is assumed if no written objection is received within 5 business days of delivery.
5. Dissatisfaction Claims
If you are dissatisfied with delivered work, please contact us immediately. We will review the work against the original project brief and, if valid concerns are identified, we will revise the deliverables at no additional cost.
6. Refund Processing
Approved refunds are processed within 10 business days to the original payment method. Processing fees may be deducted from the refund amount where applicable.
7. Dispute Resolution
Any disputes regarding refunds will be handled in accordance with German law. Both parties agree to attempt good-faith resolution before pursuing formal legal proceedings. Jurisdiction is Solingen, Germany.
